I am a British national living in Spain and marrying in Italy: what is required

This is one of the most common cases and also one of the most misunderstood: British nationality, Spanish residence, Italian ceremony. Each element points to a different authority.

Who issues proof of capacity to marry

Giving notice at a register office presupposes residence in the district. A person permanently resident in Spain will generally not be able to use that route and must apply to the British consulate for the place of residence, which issues a certificate of no impediment under its own procedures.

Before applying, it is essential to confirm which document the Italian municipality will in fact accept: the name and form vary, and a document that does not comply will be refused at the filing stage.

Documents to prepare

  • Certificate of no impediment issued by the British or consular authority
  • Apostille on that certificate, followed by a sworn translation into Italian
  • Valid passport and Spanish certificate of residence (empadronamiento), if required
  • Evidence relating to any previous marriages, with verification that foreign decisions are effective in Italy

Banns and the ceremony in Italy

A foreign party resident abroad does not normally publish banns in Italy; the formality concerns the Italian party, at the municipality of residence or at the consulate if registered with AIRE. The municipality of celebration then reviews the file and confirms the date.

Mistakes that cause delay

  • Obtaining the apostille after the translation, where the office requires it on the original
  • Applying for certificates too early and finding they expire before filing
  • Failing to confirm in advance which proof of capacity to marry the municipality accepts
